Get ready for mandatory electronic invoicing in Spain [2023]

Spain joins the list of countries that make the use of electronic invoicing mandatory in the B2B area. This is a document that digitizes this fiscal process with the intention of streamlining it. Objective of the mandatory application of electronic invoicing

The Spanish Government has decided to make the use of electronic invoices mandatory for companies. Last November 30, 2021, the Council of Ministers approved the project on B2B electronic invoicing in Spain in the Law on the Creation and Growth of Companies.

This measure was published by the General Directorate of Economic Policy and subsequently by the BOE.

Until now, the implementation of electronic invoicing was voluntary. From now on, and after the official publication, all those companies, regardless of the sector, that invoice more than eight million euros per year, will have 12 months to adapt to this obligation. And the rest of the companies, SMEs and self-employed, will be established a calendar where the obligation will be implemented gradually, during the next 3 years.

This project stems from the European Union’s Economic Recovery and Resilience Plan initiative to mitigate the impact of the pandemic on the country’s organizations and economy.

With the widespread use of electronic invoicing, the aim is to promote business digitalization and fight against late payment in commercial transactions, in order to boost business growth in Spain.

Political and economic leaders seek greater transparency in business processes as well as to promote digitalization in small and medium-sized companies that face more challenges to become competitive. 

This obligation benefits organizations, reducing transaction costs and increasing efficiency in the invoicing process. On the other hand, it will allow the State to streamline and make tax returns more transparent, especially among the self-employed and small businesses.

The new electronic invoicing must start to be used during this year and at the beginning of 2023. As approved by the Council of Ministers, as mentioned above, companies that invoice more than 8 million euros per year will have 12 months to apply this obligation.

For companies that manage a flow of sales and invoicing of less than 8 million, SMEs, micro-enterprises, entrepreneurs and self-employed, the application will be extended for 3 years, until 2025. During this period, they will have to adapt their dispatch systems to the new technology. 

The Government of Spain has also set up the Digital Toolkit Program, which aims to provide the necessary funds for companies facing challenges in the digitalization process.
